1. VALIDITY OF GENERAL TERMS AND CONDITIONS

1.1. Terms

1.1.1. This Simforte website is managed and operated by the simforte.com Group, with connectivity services being supplied by the same entity and its partners.

1.1.2. These terms and conditions, as may be amended from time to time, shall apply to all services rendered by Simforte in connection with the prepaid eSIM profiles provisioning to Clients.
By accessing, browsing, and using the Simforte.com website or any of our applications through whatever platform (hereafter collectively referred to as the “website”) and/or by completing an order, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below and the privacy statement.

1.1.3. Special offers through various business partners may incorporate additional or varied terms and conditions. In such circumstances, those special terms and conditions will prevail.

1.2. Registration and Accounts

1.2.1. The Сlient may be required to create an account to use the Simforte’s services. The Сlient agrees to provide accurate information during registration.

1.2.2. Clients are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

1.3. Privacy

1.3.1. Our Privacy Policy governs the collection and use of the Client’s personal information. By using our services, the Client agrees to our Privacy Policy.

1.4. Termination & Suspension

1.4.1. Simforte reserves the right to suspend or terminate access to the services without notice at any time due to the occurrence of an event arising from network collapse or cessation of maintenance provision.

1.4.2. In using the Services provided by Simforte, the Client must not engage in any abusive, illegal, or fraudulent actions or take any actions that could impair or damage the Network. When the Client breaches this obligation, Simforte may suspend the Client’s use of the Service.

1.4.3. All bundles offered by Simforte are intended exclusively for use by human Clients. These bundles must not be utilized within any automated system. In situations where usage within automated systems or by non-human entities is requested, the Client must contact Customer Support and request special bundles. Any violation of this usage restriction may lead to the termination of the agreement.

1.5. Refund and Cancellation policies and guidelines

1.5.1. Refunds, which are valid, are available for Clients anytime. Most issues can be solved by email.

1.5.2. After a valid refund is processed it may take 5-10 business days for the refund to show on the Client’s payment card statement (if the payment was made via credit card). Via PayPal, it takes several minutes after issuing a refund. Refunds are issued to the same payment method (i.e. credit card or PayPal) used to make the purchase.

1.5.3. All refunds (except crypto payments) are subject to a 10% fee due to credit card and other payment system charges and processing resources required to provide a product and then cancel it and issue a refund.

1.5.4. Simforte may offer data in an amount equal to what the Client paid for any accidental purchases.

1.5.5. Refills are not refundable.

1.5.6. Simforte reserves the right to terminate services at any time. In such cases, no refunds will be provided.

1.5.7. Crypto payments are not refundable.

1.5.8. Supported networks for crypto payments: Ethereum, Tron, BNB Smart Chain, Avalanche C-Chain, Solana, Polygon, Arbitrum One.

1.5.9. Supported cryptocurrencies: ‘USDT (TRC20)’, ‘BTC’, ‘DAI’, ‘AXS (ERC20)’, ‘DASH’, ‘DOGE’, ‘ETH’, ‘LTC’, ‘TUSD (ERC20)’, ‘USDC (ERC20)’, ‘USDT (ERC20)’, ‘XRP’, ‘TRX’, ‘AXS (TRC20)’, ‘HT (TRC20)’, ‘ETH (TRC20)’, ‘ETH (BEP20)’, ‘DAI (BEP20)’, ‘USDT (BEP20)’, ‘DESU (BEP20)’, ‘ADA (BEP20)’, ‘USDC (BEP20)’, ‘BTCB (BEP20)’, ‘CSC’. Please note that there is a minimum limit for the payment for each cryptocurrency.

3. REFERRAL PROGRAM

Currently only offered by sending a direct request to support@simforte.com and the Simforte team advising on the rewards available for participation.

4. DISCLAIMER

4.1. The materials on the Simforte website are provided “as is”. Simforte makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Simforte does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4.2. Network operators in countries could be changed by the Simforte team without notice.

5. LIMITATIONS

5.1. In no event shall Simforte or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Simforte Internet site, even if Simforte has been notified orally or in writing of the possibility of such damage.

6. REVISIONS AND ERRATA

6.1. The materials appearing on the Simforte website could include technical, typographical, or photographic errors. Simforte does not warrant that any of the materials on its website are accurate, complete, or current. Simforte may make changes to the materials contained on its website at any time without notice. Simforte does not, however, make any commitment to update the materials.

8. APPLICABLE LAW AND JURISDICTION

8.1. These Terms shall be construed in accordance with the laws of Singapore, Asia. In the event that the Parties are unable to amicably resolve disputes through negotiations, such disputes shall be definitively settled through arbitration mechanisms and laws of Singapore.

9.1. Simforte may revise these terms of use for its website at any time without notice. By using this website, you agree to be bound by the then current version of these Terms and Conditions of Use.
